On June 25, the Republican-controlled House approved the bipartisan Falun Gong Protection Act (FGPA). The proposal, introduced by Rep. Scott Perry (R-PA) with 18 co-sponsors, was approved by a voice vote. The FGPA is the first legislative effort specifically targeting Beijing’s severe repression of Falun Gong to make it through the House.
If enacted, the bill calls for an immediate cessation of the persecution. It will obligate the U.S. to sever cooperation with China in the organ transplantation field.
It also mandates the secretary of state, the secretary of health and the director of the National Institutes of Health to assess whether the persecution of Falun Gong practitioners constitutes an "atrocity" under the Elie Wiesel Genocide and Atrocities Prevention Act of 2018. They must also determine how much U.S. grant money has supported organ transplantation in China.
Under the FGPA, Chinese government officials, military leaders and anyone else knowingly involved in forced organ harvesting would receive significant sanctions – including up to $250,000 in civil fines, $1 million in criminal fines and up to 20 years in prison. They would also be banned from entering the U.S. and conducting transactions with U.S. entities, and their current visas would be revoked.
In the past two years, three U.S. states have enacted laws banning health insurers from funding organ transplant surgeries in China. This move is part of a broader effort to distance U.S. medical practices from the unethical practices reported in China. Additionally, Congress, United Nations-affiliated experts and the European Parliament have all publicly condemned forced organ harvesting. In 2023, the House passed its first bill addressing forced organ harvesting in a general sense, marking a significant step toward broader legislative action. The FGPA builds on this foundation by specifically targeting the persecution of Falun Gong practitioners.
Falun Gong is a spiritual practice based on meditation and the principles of compassion, truthfulness and tolerance. However, the practice has been the target of a relentless campaign in communist China that the late former Chinese paramount leader Jiang Zemin launched in 1999.
Perry spoke on the House floor about the issue's grave nature, stating that discussing forced organ harvesting in 2024 is "very frightening." He added: "If you have the money, there is no waiting list for an organ in China. There's a ready supply."
The Pennsylvania Republican also compared the current situation in China to the atrocities committed by Nazi doctor Josef Mengele during the Holocaust. He nevertheless reiterated that while the Chinese people are good, they are oppressed by a regime that is intent on suppressing dissent and expanding its influence.
Rep. Rich McCormick (R-GA) also expressed his support for the bill, stating that targeting and killing members of a religious minority for their organs is akin to a horror movie plot. He emphasized the need for America to recognize and counter the oppressive actions of the Chinese Communist regime.
Rep. Greg Stanton (D-AZ) also spoke passionately about the "unimaginable suffering" experienced by the victims, who have their basic rights stripped away and are subjected to horrific violations of their bodies. He highlighted the terror faced by those imprisoned for their beliefs, who then have their organs forcibly taken.
The FGPA now awaits Senate approval after its passage in the House. If it becomes law, it will signify a major commitment by the United States to combat human rights abuses in China. The act will serve as a strong legal and moral stance against forced organ harvesting and the persecution of Falun Gong practitioners, seeking to end a deeply troubling chapter in modern history.
