Mandated vaccination not reasonable in a free society, says ethicist

Canadian ethicist Dr. Julie Ponesse said during the television show "The Counterpoint" that informed consent is largely nonexistent when it comes to the Wuhan coronavirus (COVID-19) vaccines.

Ponesse pointed out that mandating vaccinations for full participation in society is an act of coercion that renders informed and free consent impossible. In a video that went viral, she said that mandating vaccinations, especially when it comes to a highly survivable disease, is unethical. She explained that Canadians had been given a "facade or the appearance of informed consent" because most vaccinations were done so quickly and without much of an explanation. Additionally, there are no long-term studies that can give accurate information about what side effects people will have to fight down the road.

While signing a form that indicates consent does give dubious legal consent, it is not equivalent to informed consent.

Ponesse stressed that the COVID-19 vaccines are still in their trial phases until 2023, so the notion that anyone could give fully informed consent to a medication that has not been fully vetted is absurd. Vaccines take a long time to develop, there is no long-term data and the full effects are unknown. Thus, full consent to all that cannot be given.

Furthermore, there are too many questions surrounding COVID-19 that it is unclear what the truth about the disease is. Many who have taken the vaccine did not give any thought about the severity of the virus beyond what the government propaganda or mainstream media had peddled.

Ethical issues regarding mandatory vaccination

The act of coercion that Ponesse talked about is on full display in Victoria, Australia. Premier Daniel Andrews announced that all workers on the authorized worker list will be required to get vaccinated against COVID-19 to work onsite, with all workers in the category needing to get their first dose by October 15 and be fully dosed by November 26.

Those who do not comply with the requirement will not be permitted to attend their place of work. They will have to work from home or risk losing their jobs. This requirement has potentially severe consequences insofar as human rights are concerned.

Human rights in Victoria is protected by the Charter of Human Rights and Responsibilities Act 2006. It lists a number of human rights that the state seeks to protect and promote, based on the rights enshrined in international human rights and instruments.

One of the rights enumerated in the Charter Act states that a person " must not be subjected to medical treatment without his or her full, free and informed consent. Because vaccination is a medical procedure, forcing a person to be vaccinated against his or her will is a clear violation of this right."

Another section states that every person has the right to move freely within the state and has the freedom to choose where to live. "Requiring that a person may not travel to his or her place of employment without being vaccinated limits this right."

All the rights protected in the Charter Act is the concept of autonomy and dignity, and each person has the right to determine for himself or herself matters of bodily integrity, including whether or not to be vaccinated.

While it is true that many rights are not absolute and may be limited in some circumstances to take into account the rights and freedoms of others, it will not be consistent with human rights laws to force a person through "informed consent" to undergo medical experimentation to discover a remedy that could potentially cure others.

The right not to be subjected to medical treatment is a fundamental right that cannot be set aside for the interest of others.

In which case, international law provides a strong indication that the right not to be subjected to medical treatment is an absolute right that cannot be limited, and this should set the bar high on any attempt of the government or pharmaceutical companies to attempt to mandate forms of medical treatment, including vaccination.
