Florida Gov. Ron DeSantis joined a growing chorus of state leaders calling for the prosecution of Dr. Anthony Fauci, a longtime critic of the former White House advisor's role in the Wuhan coronavirus (COVID-19) pandemic response.
DeSantis, who has been a vocal opponent of Fauci and his actions during the pandemic, suggested that the new state attorney general, James Uthmeier, could investigate and potentially prosecute Fauci under state law in a recent speech at the Yale Federalist Society. Uthmeier, who previously served as the chief of staff of DeSantis, is likely to pursue such an investigation.
"I think he's of the mindset to look at this, to see what the jurisdictional hooks are, to see what if any statutes would have been violated," DeSantis said. He then added that the pardon granted by former President Joe Biden "may end up boomeranging against Fauci."
"Biden intended to shield him from accountability and it may have actually sparked state-based efforts to ensure his accountability," DeSantis said, adding that "some other states would also do it." (Related: Fauci could still face legal troubles despite Biden's backdated pardon.)
DeSantis echoed the sentiments of 17 state attorneys general who recently sent a letter to Congress, urging the federal government to share evidence that could implicate Fauci in potential wrongdoing. This came even after the preemptive pardon of Biden to Fauci.
The letter, signed by attorneys general from Alabama, Arkansas, Florida, Idaho, Indiana, Kansas, Louisiana, Missouri, Montana, Nebraska, North Dakota, South Carolina, South Dakota, Tennessee, Texas, Utah and West Virginia, emphasizes the principle of dual sovereignty.
"While Biden's preemptive pardon is likely to shield Fauci from federal prosecution, it does not preclude state prosecution," said Atty. Greg Glaser. "Under the legal principle of dual sovereignty, each state retains the authority to pursue its own investigations and prosecutions for violations of its own state law. This is supported, for example, by the Tenth Amendment, which reserves powers not delegated to the federal government to the states."
The letter also references the final report of the U.S. House Select Subcommittee on the Coronavirus Pandemic, released in December 2024, which outlined several areas where Fauci and others may have engaged in potential wrongdoing or misconduct.
These areas include possible cover-ups of COVID-19 origins, failures in the oversight of National Institutes of Health (NIH) grants and Fauci's pandemic policies, which "contributed to a profound erosion of public trust in health institutions."
The "lab-leak theory" of COVID-19's origin, which suggests the virus escaped from the Wuhan laboratory, is also mentioned in the letter. Additionally, the letter highlights allegations that Fauci suppressed key information about the potential health risks and adverse events of the COVID-19 vaccines.
"Dr. Fauci led a deliberate campaign to stifle the voices of premier health scholars regarding the lack of adequate testing of vaccines," the AGs wrote in the letter addressed to Senate Majority Leader John Thune (R-S.D.) and House Speaker Mike Johnson (R-La.).
"This subsequently siloed crucial information from the public that may have led to more public awareness concerning the risks of myocarditis and pericarditis among young adult males; the verified increased risk of blood clots in women; and the long-term effects vaccines had on fertility."
