Free speech under fire: Brian Festa defends constitutional rights in We The Patriots USA’s lawsuits
01/08/2025 // Kevin Hughes // Views

  • Brian Festa, co-founder of We The Patriots USA, is leading efforts to defend First Amendment rights against government overreach, encompassing various causes including free speech, religious freedom and protection against wrongful accusations of child abuse.
  • Festa's organization is litigating a case on behalf of Mirella Ramirez, a fired kindergarten teacher from Oakland, California, who was compelled to use gender-specific pronouns contrary to her religious beliefs. The lawsuit argues that the termination violated Ramirez's First Amendment rights.
  • WTP USA is also involved in litigation against medical kidnapping and wrongful placement on the child abuse registry for the Guidry family of Missouri, who rely on alternative medical treatments, highlighting the dangers of state interference in families' medical decisions.
  • Festa co-led a lawsuit challenging the TikTok ban, alleging free speech violations by the U.S. government's efforts to censor certain social media platforms.
  • These legal battles underscore the need to protect individual rights to free speech and expression, particularly in public education and the broader public sphere, underlining the critical role of organizations like WTP USA in preserving democratic values and constitutional rights.

In a new wave of legal challenges, We The Patriots USA (WTP USA) co-founder Brian Festa is leading the charge to protect First Amendment rights in the face of increasing government overreach.

From fighting against forced speech in classrooms to defending individuals wrongfully accused of child abuse, Festa's organization is taking a multi-front approach to safeguard the freedoms guaranteed by the U.S. Constitution. The civil rights attorney talked about it during an interview with the Health Ranger Mike Adams in a recent "Health Ranger Report" episode.

One of the most recent cases brought to light by Festa involves Mirella Ramirez, a kindergarten teacher in Oakland, California, who was fired for refusing to use preferred pronouns in her classroom. Ramirez, a devout Catholic, objected on the grounds that it violated her religious beliefs and the Catholic faith's stance on gender identity.

The Oakland Unified School District (OUSD), a state actor bound by the Constitution, compelled Ramirez to use gender-specific pronouns for a student despite her objections, leading to her termination. Festa's team subsequently filed a lawsuit against the OUSD, arguing that the case is fundamentally about free speech and religious freedom.

The complaint, which spans 30 pages, contends that Ramirez's firing is a violation of her rights guaranteed under the First Amendment – as she was compelled to speak in a manner that contradicts her beliefs. The case sets a precedent that could potentially protect teachers and other public figures from being forced to espouse government-endorsed views in opposition to their personal or religious convictions.

Festa describes medical kidnapping as a "scourge," and rightly so

Another significant case tackled by Festa's organization is the ongoing litigation involving Paul and Amanda Guidry of Missouri, who faced the medical kidnapping of their four children due to their reliance on alternative medical treatments. Despite the family's victory in having their children returned, they continue to battle against being wrongfully placed on the child abuse registry.

"Medical kidnapping is so important because it's a scourge in America right now. People don't realize how big and widespread the problem is. It's happening in every state. I don't care whether it's a red state, a swing state, a blue state, it's happening everywhere. So that's how big it is," Festa said.

The attorney is also engaged in challenging government mandates on social media platforms. The TikTok ban lawsuit, which he co-led with Robert F. Kennedy Jr., aims to strike down the U.S. government's efforts to censor certain platforms on the grounds of free speech violations. (Related: TikTok files emergency injunction to block U.S. ban, citing Constitutional violations and lack of evidence.)

"There's a lot of people out there that don't like your content, there's people on the other side of these issues that don't want you saying the things you're saying. But that's wrong because whether we agree with it, whether I personally agree with what you're saying or not, it doesn't matter," Festa told Adams.

"You have a right to say it. This is America. You have a right to share information publicly. Truth and knowledge are power, and they know that."

In addition to these cases, Festa's organization is actively supporting individuals coerced into taking certain medical treatments, such as parents who face accusations of neglect or abuse for choosing breastfeeding over formula for their infants.

The broader implications of these legal battles extend beyond the immediate cases. Festa's work highlights the critical need to protect the rights of individuals to express their views without fear of retribution or compulsion, especially within the context of public education and the broader public square. As the conflict between government mandates and First Amendment rights intensifies, the legal actions championed by Festa's organization are at the forefront of this struggle.
