According to court documents, Kindle and Cole allegedly used their positions as federal agents to acquire illegal drugs, including synthetic substances known as “bath salts,” from DHS evidence lockers and other law enforcement personnel. They falsely claimed the drugs were needed for legitimate investigations, only to sell them through a confidential informant who resold the substances on the streets of Utah. The FBI estimates the scheme generated between $195,000 and $300,000 in profits between 2022 and 2024.

The agents’ alleged crimes go beyond drug trafficking. Prosecutors accuse them of stealing thousands of dollars in cash, a diamond ring, and a Peruvian antiquity from evidence. They reportedly used encrypted messaging apps to coordinate drug deals, directing their informant to meet at locations such as a Panera Bread restaurant and a Nike store. In one instance, the informant retrieved a foam cup containing drugs from a parking lot trash can, a brazen act that highlights the agents’ disregard for the law they were sworn to uphold.

Kindle and Cole’s alleged misconduct began as early as 2021, when they started stealing drugs from evidence and lying to fellow agents about their intentions. Despite their arrests and the suspension of their DHS credentials, neither has been fired, a fact that will undoubtedly fuel public skepticism about the government’s ability to hold its own accountable.

The case came to light in October 2024, when the informant’s lawyer contacted the U.S. Attorney’s Office in Utah, alleging that Kindle and Cole had coerced their client into participating in illegal activities. The FBI launched an investigation, recording eight instances of illegal drug sales to the informant.

Kindle faces charges of felony drug distribution conspiracy and conspiracy to convert U.S. government property for personal gain. His court date is set for January 21, and he could face up to 25 years in prison if convicted. Cole, who pleaded not guilty, is charged with felony drug distribution conspiracy and will stand trial beginning February 24. He faces up to 20 years in prison.
