The revised indictment, filed by Smith's office in August, reaffirms the charges against Trump while limiting and reframing the allegations following a Supreme Court ruling that grants immunity to former presidents for official acts performed while in office. The decision of the Supreme Court effectively removes accusations that Trump attempted to use the Department of Justice (DOJ) and White House advisers to reverse his 2020 loss. In turn, Smith revised the filing to focus on Trump's alleged attempts to pressure former Vice President Mike Pence to reject the electoral votes of certain states and to certify Trump as the true winner of the election, not President Joe Biden. It also clarifies Trump's actions as a candidate and his conversations with Pence, who was serving in his ceremonial role as president of the Senate during the certification process.
But despite the revisions, the indictment continues to accuse Trump of enlisting slates of fake electors in key states that Biden supposedly won to attest that Trump secured victory at that time.
Additionally, Smith is keeping four other charges previously filed against Trump which he pleaded not guilty to last August: conspiracy to defraud the United States; conspiracy to obstruct an official proceeding – specifically, the congressional certification of the 2020 election's results; obstruction of and attempt to obstruct an official proceeding; and conspiracy against rights.
Overall, the new indictment asserts that Trump and his co-conspirators continued to propagate claims of election fraud that were "unsupported, objectively unreasonable and ever-changing," even after they had been publicly debunked.
"These claims were unsupported, objectively unreasonable, and ever-changing, and the Defendant and his co-conspirators repeated them even after they were publicly disproven," the new indictment stated. "These claims were false, and the Defendant knew that they were false."
In response to all these accusations, Trump submitted a court filing on Sept. 4 to plead not guilty before the status hearing before U.S. District Judge Tanya Chutkan of the U.S. District Court for the District of Columbia on Sept. 5.
"I, President Donald J. Trump … do hereby waive my right to be present at Arraignment and I authorize my attorneys to enter a plea of not guilty on my behalf to each and every count of the superseding indictment, Doc. 226," he said in the court filing. "I further state that I have received a copy of the superseding indictment and reviewed it with my counsel."
Aside from pleading not guilty, Trump denounced the new indictment on his official Truth Social account as a "direct attack on democracy" shortly after its release.
He claimed that the case against him pertains to "Conspiracy to Obstruct the 2020 Presidential Election" and argued that his opponents, not him, were responsible for obstructing the election.
"For them to do this immediately after our Supreme Court Victory on Immunity and more, is shocking. I’ve also been informed by my attorneys, that you’re not even allowed to bring cases literally right before an Election – A direct assault on Democracy! This is an unprecedented abuse of the Criminal Justice System. The case has to do with "Conspiracy to Obstruct the 2020 Presidential Election," when they are the ones that did the obstructing of the Election, not me."
"They cheated on the Election, and they go after me for 'cheating on the Election.' Interestingly, this comes at the exact same time as Mark Zuckerberg of Facebook has admitted to concealing massive amounts of information, such as Hunter Biden’s Laptop from Hell, which is a direct acknowledgment that the 2020 Presidential Election was MANIPULATED and RIGGED by the DOJ. What they are doing now is the single greatest sabotage of our Democracy in History," Trump posted on Truth Social on Aug. 28.
