In one example, a noncitizen who checked the box on the California Department of Motor Vehicles (DMV) paperwork indicating that they are not an American citizen still received a voter registration form in the mail.
The California resident was allowed to acquire a driver's license because 19 states and the District of Columbia (D.C.) do not require citizenship for new drivers.
At the same time, the National Voter Registration Act (NVRA) requires state DMVs to give a choice for those getting or renewing a driver's license to register to vote on the same form.
If a noncitizen claims to have United States citizenship — by simply checking a box — that is considered a valid attestation, and the person is registered to vote, and the only way they will be caught is if voter rolls are reviewed through audits. Three states – New Mexico, Tennessee and Virginia – also require applicants to provide full Social Security numbers before they are added to the rolls.
Like the other 18 states and D.C., California lacks supplementary laws requiring more strict proof of citizenship for voter registration.
This makes the probability of noncitizens illegally voting in state and federal elections a real concern.
While the American government's mandated transition to REAL ID should prevent noncitizens from being able to register to vote through their driver's license application – as they cannot acquire a REAL ID under federal law – some states are already creating loopholes.

California is not the only state where this is happening. Reports indicate that welfare offices and other state and federal agencies in at least 45 other U.S. states are providing voter registration forms to migrants, without requiring that they provide proof of citizenship before filling them out.
The ease with which legal and illegal immigrants alike are receiving voter registration forms comes from the fact that every state in the country except for four – North Dakota, New Hampshire, Wisconsin and Wyoming – receive information from citizens for certain state benefits and privileges without requiring proof of citizenship.
These benefits and privileges include applying for driver's licenses – the same case as in California, D.C. and 18 other states – and welfare benefits.
Worse yet, in some cases many states do not require proof of citizenship for residents who want to apply for mail-in ballot federal voter registration forms. This is because there is currently no federal requirement to provide proof of U.S. citizenship to receive federal voting forms, although it is illegal for a noncitizen to falsely claim to be a citizen to cast a ballot in a federal election.
Millions of migrants with humanitarian parole, refugee or asylum status are still eligible for at least one of these benefits that would bring them to the offices where voter registration takes place.
"While President Joe Biden and radical Democrats give ISIS and criminals a smartphone app to literally schedule their illegal entry, Republicans must fight any chance of illegal voter registration until we can mass deport," said Rep. Chip Roy (R-TX).
