The EO titled "A Proclamation on Securing the Border," which took effect on June 5, aims to address the surging numbers of illegal border crossers entering the United States. It stipulates that asylum applications will be denied when the seven-day average of migrant apprehensions at the southwest border exceeds 2,500 per day. But newly released data from several reports beg to differ.
For instance, data from NewsNation reveals that nearly 4,000 migrants were apprehended on the first full day of the order, with numbers escalating to 10,000 by June 8. That same day, Fox News reported 5,600 Customs and Border Protection (CBP) encounters recorded on the first day of the order, including 4,000 illegal crossings. The next day on June 9, the New York Post reported that approximately 10,000 migrants were in Border Patrol custody – four times the limit set by Biden's order.
John Modlin, chief patrol agent of the Border Patrol's Tucson Sector, reported the same in his sector with 7,500 apprehensions in the first week of June, consistent with the 7,800 apprehensions of the previous week and higher than earlier weeks in May. Meanwhile, San Diego County Supervisor Jim Desmond noted that thousands of migrants entered the county over the weekend, adding to the 151,000 street releases recorded this fiscal year.
"Biden’s executive order is a facade, offering the illusion of security while doing nothing to address the real issues at our borders," Desmond stated as he described the EO.

Texas Gov. Greg Abbott also echoed these concerns, blasting the Biden administration for refusing to implement effective deterrents for illegal crossings. "As long as the Biden administration refuses to provide any type of enforcement, any type of blockage of people crossing illegally, all this new Biden policy is going to do is to actually attract and invite even more people to cross the border illegally," Abott told Fox News' Maria Bartiromo on June 9.
"And you've seen on videos ever since the Biden order went into place. There's no slowing down of people crossing the border. In fact, it's just accelerating."
CBP agent: EO would only normalize illegal border crossings
Meanwhile, an anonymous senior CBP source suggested that the latest EO by Biden won't significantly curb the influx of illegals. Instead, the edict would do the opposite and normalize the entry of two million migrants annually.
They argued that the threshold set by the EO could still allow almost a million migrant apprehensions per year without limiting asylum eligibility. This is particularly true if cartels or the Mexican government manage border crossings to stay just below this threshold.
The source also noted that "lawful pathways" implemented during the Biden administration have already permitted the entry of nearly one million additional "legal" migrants at U.S. ports, who often enter the country unnoticed.
Moreover, the new executive order does not address the 800 to 1,000 migrants evading capture daily. Instead, these lawful pathways, strategic illegal crossings under the threshold, and "gotaways" could result in over two million migrants entering the U.S. annually without facing the EO's consequences.
"Some of the statements contained within the order are outright lies. The order attributes low migrant crossings in 2020 to travel restrictions placed by other countries during the COVID pandemic – that's a lie," the source said.
