Title 42 is the name for a series of restrictions instituted by former President Donald Trump in March 2020 in response to the Wuhan coronavirus (COVID-19) pandemic. The order allowed border agents to expedite the process of expelling illegal immigrants, who entered the U.S. from Mexico, on the basis of protecting public health. Democrats, including Biden, have repeatedly criticized Title 42's health justification, claiming it was part of Trump's overall goal of curbing both legal and illegal immigration in a way that violates human rights.
When Biden took office in 2021, he vowed to reverse what he called Trump's overly-restrictive approach to immigration. Since Biden took office, more than six million people have been admitted through the border legally, illegally and quasi-legally. This means that for every four American citizens born, up to three migrants made their way across the border.

Biden's administration has announced that it intends to lift Title 42 next Thursday, May 11, when America's own COVID-19 public health emergency ends. What this means is that when illegal immigrants are caught by Customs and Border Patrol (CBP) agents illegally crossing the border, they will again be allowed to request asylum – a process that can take years to resolve and during which time the so-called asylum speakers will be allowed to live and work in the United States.
As the deadline approaches, more and more illegals are attempting border crossings. In April, Border Patrol reportedly apprehended over 183,000 illegal immigrants. More than 19,000 of these migrants are currently being held in CBP facilities, exceeding capacity by over 200 percent.
Meanwhile, the White House is doing very little to prepare for what will happen to Texas and other border states once Title 42 ends. Department of Homeland Security Secretary Alejandro Mayorkas claimed he feels confident that current protocols will be able to handle the influx. But Border Patrol agents are concerned that the lack of new action will prompt more illegals to make the journey north.
Republicans have similarly raised their concerns over how Biden remains far too lax on immigration policies.
"They're putting all their time and effort into illegal immigration, finding ways to increase capacity [in holding facilities], finding ways where people can come over illegally quicker," said GOP Rep. Tony Gonzales of Texas' 23rd congressional district, which runs along the majority of the state's border with Mexico.
"The reality is nine out of 10 people that come over into our country illegally do not qualify for asylum," he added. "You haven't heard the president say one thing about immigration other than just blame others."
