According to her intent to sue notice, Cole underwent harmful transgender treatment between the ages of 13 and 17 years old, which constitutes a breach of the standard of care. She took puberty blockers and off-label cross-sex hormone treatment and went through a double mastectomy when she was 15.
"This radical, off-label and inadequately studied course of chemical and surgical 'treatment' for Chloe's mental condition amounted to medical experimentation on Chloe. As occurs in most gender dysphoria cases, Chloe's psychological condition resolved on its own when she was close to reaching adulthood, and she no longer desires to identify as a male," the letter stated.
The 18-year-old teenager is now suffering from deep emotional wounds, severe regrets and distrust for the medical system. Chloe has suffered physically, socially, neurologically and psychologically and lost social development with her peers at milestones that can never be reversed or regained.
The said notice is addressed to Dr. Lisa Kristine Taylor, Dr. Hop Nguyen Le and Susanne E. Watson, as well as Permanente Medical Group, Kaiser Foundation Health Plan and Kaiser Foundation Hospitals. Cole is represented by LiMandri & Jonna LLP, along with Dhillon Law Group and the Center for American Liberty (CAL).
These medical practitioners "coerced Chloe and her parents to undergo what amounted to a medical experiment by propagating two lies," said the lawyers in the letter. "The first was telling them that her gender dysphoria would not dissipate by itself and the second was that Cole was at risk of suicide if she did not socially and medically transition. Both of these statements were false."
The notice also highlighted the complete failure of the doctors to properly advise Chloe and her parents of the serious risks of undergoing this permanent treatment that amounted to medical experimentation on Chloe. It further stated that there was no informed consent regarding the dangers of puberty blockers, testosterone treatment (especially for females), or double mastectomy surgery.
The 14-page document explained the extent of the medical malpractices and stated that her representatives will be seeking "punitive damages based on the evidence of malice, oppression and fraud."
"I want to create a precedent for other people who have been in my situation to find justice themselves," Cole said during an appearance on the Fox News program "Tucker Carlson Tonight." She was accompanied by her lawyer, CAL founder Harmeet Dhillon.
The former FTM-turned-detransitioner admitted to having a hard time coping with the loss of her breasts. The surgeries have also affected other aspects of her health.
"As an adult, I will never be able to breast-feed whatever children I will have," Cole told program host Tucker Carlson. "Because I was put on puberty blockers and testosterone at only 13 years old, I don't know if I'll be able to conceive a child naturally. I made an adult decision as a child."
Dhillon told the host that they wish to see an end to this "barbaric and unnatural medical malpractice."
"What happened to me is horrible, but it didn't only happen to me. That's the worst part," Cole said. "It's happening to children all over the U.S., all over the West, and it's spreading all over the world."
Back in August, Cole also denounced a proposal making California a "transgender refuge state." Senate Bill (SB) 107 ensures that "families with trans kids can seek refuge in [California] if other states criminalize them for allowing their kids to get healthcare."
The bill was backed by State Sen. Scott Wiener, who is an open member of the LGBT community.
"As a detransitioner that has testified across from Weiner on this bill, I can say that this bill has many unintended consequences that are immoral and will take away rights from parents across the entire United States."
