Press conference held on steps of U.S. Supreme Court regarding the future of vaccine safety

(NewsTarget) Beneath the words "Equal Justice Under Law" a press conference was held Thursday, March 3, 2011 on the steps of the U.S. Supreme Court to denounce the decision in the matter of Bruesewitz v. Wyeth. In a blow to thousands of families damaged by vaccines, the High Court struck down the right to sue for gross negligence with regards to defectively designed vaccines, thus giving vaccine manufacturers blanket immunity. In the forefront of this battle stood Russ and Robalee Bruesewitz, parents of Hannah Bruesewitz, along with vaccine safety and autism leaders Mary Holland, Louise Kuo Habakus, Jim Turner, Rolf Hazlehurst and additional families involved in the debate. Together they spoke on behalf of the many thousands of families and advocates deeply disappointed in the Court's decision and now concerned as to the future of vaccine safety.

During the course of the press conference speakers called upon Congress to re-visit the National Childhood Vaccine Injury Compensation Act of 1986 to re-define language so as to clearly allow for Civil Court suits in matters of vaccine damage. As a result of the Supreme Court decision, the Vaccine Court is now the first and only recourse for compensation. Historically, as few as one out of every five claims can expect compensation. As clearly stated by family members at the press conference, the system is slow, tedious and seemingly unfair.

The Vaccine Court is not, in the real sense of the word, a court of law. There is no judge or jury of your peers, basic rules of law do not apply and there is no evidentiary proceedings. It is the Office of Special Masters of the U.S. Court of Federal Claims which administers a no-fault system of justice. The power is certainly not on the side of a citizen. It is a court fabricated by the U.S. Government, designed to act in a way that feigns justice and protects vaccine manufacturers from liability.

Russ Bruesewitz asked the critical question, "Is our daughter, Hannah, an acceptable casualty?" All parents, including the Bruesewitzes, who have witnessed first hand the damage caused by vaccines, most certainly respond with a definitive and resounding no. This decision is a profound betrayal of trust and one that should not be tolerated.

Ultimately, there is a collusion of interests held within the trilogy of the FDA, CDC and vaccine manufacturers that needs to be further examined to see if a fair decision is ever even possible. It is only the vigorous and reasoned dissent by Justice Sotomayer in this case which gives vaccine safety advocates a place from which to start in building a consensus. Sotomayor unequivocally stated in her dissent, "Nothing in the text, structure, or legislative history of the Vaccine Act remotely suggests that Congress intended such a result." These are powerful words from a respected judge and words we can point to as we continue on the journey toward holding vaccine manufacturers accountable for their many egregious acts.

The High Court admitted in its decision that vaccines are "unavoidably unsafe". If that revelation does not instill fear into every vaccinating parent, there is little else to be said. The time is now to dissent from a system which could only be described as criminally negligent, acting without a judge, jury or any access to reason. It is most certainly not "Equal Justice Under Law" and we most certainly should not take it from our seats.
